A. Introduction
This Data Privacy Notice conveys the policy of the National Police Commission (NAPOLCOM) in the collection, use, processing, storage, and disposal of your personal data.
The NAPOLCOM respects and upholds all individual’s right to privacy. Consistent with the principles of transparency, legitimate purpose, and proportionality, the NAPOLCOM commits that all personal information of its data subjects is collected, processed, stored, and disposed in compliance with Republic Act No. 10173 (R.A. 10173), otherwise known as the Data Privacy Act of 2012, its Implementing Rules and Regulations (IRR), and existing Memorandum Circulars and Advisories issued by the National Privacy Commission (NPC).
Please note that the terms “data” and “information” are used interchangeably in this Data Privacy Notice. When we speak of personal data, it can refer to either personal information (PI) or sensitive personal information (SPI). And in general, “personal information” is defined as any information whether recorded in a material from or not, from which the identity of the individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.
B. Collection and Processing of Personal Information
The NAPOLCOM collects, acquires, and generates personal data from written records, photographic and video images, digital material, and even biometric records, such as: names, family background, educational background, disciplinary records, service records, email address, telephone number, and other contact details. The NAPOLCOM collects information in a transparent way and only with the full cooperation, knowledge, and consent of interested parties.
In the processing of data, NAPOLCOM is committed to upholding the principles as espoused in the Data Privacy Act of 2012 and Executive Order No. 2, s. 2016, entitled: Operationalizing In The Executive Branch The People’s Constitutional Right To Information And The State Policies To Full Public Disclosure And Transparency In The Public Service And Providing Guidelines Therefor
C. Purpose and Use of Personal Information
The NAPOLCOM processes and collects personal information for purposes connected with our constitutional and statutory mandate of administering and controlling the PNP, as provided for under Article XVI, Section 6, of the 1987 Constitution, as well as Republic Act No. 6975 (Department of the Interior and Local Government Act of 1990) and Republic Act No. 8551 (Philippine National Police Reform and Reorganization Act of 1998), as amended. In this regard, data collected by the NAPOLCOM may be collected and processed in connection with any of the following purposes:

- Application for entrance examination;
- Application for promotional examination;
- Application in securing report of rating in NAPOLCOM administered examinations;
- Application for conferment of Police Executive Service Eligibility (PESE);
- Issuance of Certificate of Pending/No Pending Administrative Complaint;
- Issuance of Certificate of Pending/No Pending Summary Dismissal Case;
- Application for Travel Authority;
- Application for Promotion;
- Application for Total Permanent Disability Benefits (TPPD);
- Application for Death Benefits;
- Application for Scholarship Benefits;
- Adjudication of Summary Dismissal Cases;
- Adjudication of Appeals from Dropping from the Rolls (DFR);
- Adjudication of Appeals from Termination Proceedings (TP);
- Adjudication of Appeals from Citizens Complaint Cases;
- Adjudication of Appeals from Breach of Internal Discipline Cases;
- Adjudication of Appeals from Summary Dismissal Cases;
D. Storage and Disposal of Data
The NAPOLCOM stores personal data in a data center (on premise) and physical document storage facilities. The NAPOLCOM retains personal data strictly in accordance with operational needs and in compliance with legal and regulatory purposes.
In general, the NAPOLCOM retains personal data for a period of five (5) years after the processing relevant to the purpose has been terminated. However, the NAPOLCOM reserves the right to retain the data subject’s personal data when necessary to establish, exercise or defend legal claims, or for legitimate business purposes, or when provided for by law.
The NAPOLCOM’s data retention and disposal policy is in compliance with Republic Act No. 9470, otherwise known as the National Archives of the Philippines Act.
E. Security of Personal Information
NAPOLCOM implements security measures in allowing only authorized personnel access to both personal, and sensitive personal information. Likewise, all physical documents that contain personal information or sensitive personal information are kept in secured storage rooms and/or placed within locked cabinets/drawers.
F. Rights of Data Subject
Under the Data Privacy Act of 2012, people whose personal information is collected and processed are called data subjects. We are duty bound to observe and respect your privacy rights, including your right to information, right to access, right to correct, right to remove, right to damages and right to data portability.
G. Effectivity and Changes to the Data Privacy Notice
This Data Privacy Notice is effective as of (insert date of approval by the Vice Chairperson and Executive Officer). Whenever it becomes necessary, changes to the NAPOLCOM’s Data Privacy Notice shall be posted herein as soon as it is approved. Rest assured, however, that any changes will not be retroactively applied and will not alter how we handle previously collected information.
